Who Can Obtain the FSSAI License or Registration?

The FSSAI (Food Safety and Standards Authority of India) Basic Registration is a regulatory requirement for various businesses involved in food-related activities. It's mandatory for:

  1. Small-scale food operations: Businesses dealing with specific quantities of food items per day fall under this category. For instance, those handling less than 100 kg/ltr per day of food capacity (excluding certain items like milk and meat products) need this registration.

  2. Milk-related activities: Entities processing up to 500 litres of milk per day or producing 2.5 Metric Tons (MT) of milk solids annually are required to obtain this registration.

  3. Vegetable oil processing: Businesses with turnovers of up to 100 kg or liters per day in vegetable oil-related processes also need this registration.

  4. Larger-scale meat processing and slaughtering: Entities handling more than 100 kgs per day or 30 MT per day in meat processing or with slaughtering capacities under specified limits for different animals (2 large animals, 10 small animals, or 50 poultry birds per day) fall under this requirement.

  5. Various food-related businesses: Cold storage units, wholesalers, retailers, distributors, dhaba owners, clubs/canteens, hotels/restaurants, and transporters with turnovers up to Rs.12 lakhs annually must also secure this registration to comply with FSSAI regulations.

    4. Relevant business documents such as Partnership Deed, Certificate of Incorporation (COI), Memorandum of Association (MOA), or Articles of Association (AOA).
    5. Proof of the business premises like a lease or rental agreement.
    6. Implementation of a Food Safety Management System (FSMS) plan.
    7. Supporting documents such as NOC from Panchayat/Municipality, Health NOC, if applicable.
    8. List of suppliers providing raw materials.
    9. Submission of Form IX, water test report facilitated by a certified NABL lab, and Import-Export Code (IEC) granted by DGFT.
    10. Inventory of machines and equipment present at the facility.
    11. Details of directors and partners associated with the business.

    Penalties for Violation of FSSAI Regulatory Guidelines

    The FSS Act outlines specific penalties for various punishable offenses related to food trade and quality:

    1. Individuals trading non-branded food articles, whether directly or through independent third parties, can face penalties of up to 5 lakhs.
    2. Selling low-quality food items, whether directly or through independent third parties, holds individuals accountable for penalties as per FSSAI regulations.
    3. Those involved in trading, marketing, storing, or importing food items available to the public with extraneous matter may incur fines of up to Rs 1 lakh.
    4. Individuals manufacturing or processing food intended for public consumption under unsafe or unhygienic conditions face penalties of Rs 1 lakh.
    5. In severe cases where substandard food has caused life-threatening situations for consumers, the fine for the offender may escalate to Rs 5 lakhs.
